LA PRISE EN COMPTE DU LIEN MATRIMONIAL EN DROIT COMMERCIAL

Résumé

La prise en compte du lien matrimonial en Droit commercial se manifeste diversement.Elle intervient d’abord dans le cadre de l’activité professionnelle du conjoint in bonis. Danscette hypothèse, le lien matrimonial est pris en compte aussi bien dans la détermination del’activité professionnelle du conjoint que dans l’exercice d’une telle activité. A tous cesniveaux, apparaît le rôle protecteur de la prise en compte du lien matrimonial à traversdiverses techniques juridiques. Ensuite, la prise en compte du lien matrimonial s’observe dansle cadre du droit des procédures collectives. Dans ce cas, il s’agit avant tout de règlesconcernant le conjoint du débiteur en cessation des paiements, en préservant ses droits.D’autres règles protègent les tiers à travers les droits reconnus à la masse des créanciers et ensoumettant le conjoint à certaines contraintes.

Abstract :Takingaccount of the marriage bond in OHADA commercial lawmanifestsdifferently. Itoccurs first in the career of the spouse in bonuses.
