EVOLUTION CREATRICE DES DROITS DE L’HOMME A TRAVERS L’HISTORIALITE DES TEXTES FONDAMENTAUX.

Résumé

Depuis le 18èmesiècle, les droits de l’homme sont au centre d’une réflexion philosophique sur le concept d’homme et la quête du sens de la notion de vie. Au-delà de leurs fondements théoriques, de leur rapport avec des combats politiques, leur dimension juridique ne peut plus être ignorée. Car issus d’une véritable révolution par rapport au droit international classique, ils constituent aujourd’hui une garantie des libertés fondamentales dont l’importance ne fait que croître avec l’évolution de la vie de l’homme. Aussi mettre en exergue la longue marche des droits de l’homme à travers quelques textes importants nous paraît nécessaire pour montrer qu’ils ne sont pas une invention de l’Occident, mais la conséquence d’un élan vital créateur de valeurs morales et spirituelles protectrices de la vie elle-même. C’est pourquoi les droits de l’homme vont être consacrés depuis la déclaration des droits de l’homme et du citoyen de 1789 par des textes à caractères normatifs obligatoires au plan international.

Abstract
Since the 18th century, human rights are central to a philosophical reflection on the concept of human being and of the meaning of the concept of life. Beyond their theoretical foundations, their relation with political fights, their legal dimension cannot be unknown. For, derived from a true revolution in relation with the international classical law, they are nowadays a guarantee of fundamental freedoms whose importance allows for increasing the human being evolution. So, underscoring the long progress of human rights through some major texts seems, as for us, necessary to prove that they are not a coining of the West; but the result of a vital creative drive of moral and spiritual values protecting the very life. That is the raison why human rights are consecrated since the Declaration of Rights of Man and of Citizen of 1789 by the texts of compulsory normative nature at the international level.
