Vers une inversion des rapports de force en droit privé malien ?

Résumé : Les textes issus de la période coloniale et la jurisprudence relative à ces textesne consacraient pas expressément la suprématie de la partie économiquement forte, mais ilsne l’empêchaient pas totalement, en raison de leur insuffisance, malgré les efforts dulégislateur et des juges français. Cette suprématie se manifestait aussi bien dans les rapportscontractuels, que dans les rapports extracontractuels. Après avoir pris conscience dudéséquilibre des rapports de force en droit privé, le législateur malien a adopté des textes quivisent à rétablir l’équilibre entre les parties. Parallèlement, la suprématie de la partieéconomiquement forte a conduit les consommateurs à se regrouper en associations. Leursactions entraînent un infléchissement de la puissance économique.

Summary : texts stemming from colonial period and jurisprudence relative to these texts didnot dedicate expressly the ascendancy of the economically strong party, but they did notprevent it totally, because of their insufficiency, in spite of the efforts of the legislator and theFrench judges. This ascendancy showed itself as well in the contractual relationships, as in theextracontractual relationships. Having become aware of the imbalance of the balance ofpower in private law, the Malian legislator adopted texts which aim at restoring the balancebetween the parties. At the same time, the ascendancy of the economically strong party ledthe consumers to group together in associations. Their actions pull a reorientation of theeconomic power.
